Pre-contractual information

With the transmission of this document, the selling company also offers the consumer the pre-contractual information referred to in art. 1 of Legislative Decree 21/14 as well as pursuant to articles 45 et seq. of Legislative Decree 206/05.

Therefore, before completing the payment, the consumer agrees to receive, by clicking on the appropriate mandatory checkbox, on a durable medium (e-mail or pdf attached to an e-mail) the following document containing all the legal indications to identify the seller and inform the buyer of the rights enjoyed in compliance with the provisions of the consumer code.

The information provided will then form an integral part of the distance contract or the contract negotiated away from business premises, in case of order confirmation, and cannot be changed except with the express agreement of the parties.

Information on products

The characteristics and the price of the various products for sale on the Site (hereinafter "Product" or "Products") are shown on the page relating to each item. Each product has a dedicated card that indicates the name of the manufacturer and all the main characteristics of the article. The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the description sheet. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may not be fully representative of its characteristics and quality but may differ in color and size. In fact, the images and colors of the Products presented on the Site may however not correspond to the real ones due to the Internet browser and monitor used. In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails. Small variations between these photographs and reality do not constitute defects of conformity.

Legal guarantee for conformity defect

The selling company sells first quality products.

The company does not sell used, flawed products or products of lower quality than the corresponding market standards. In the description of each product, however, the selling company will take care to specify the storage conditions of the specific Product if it differs from the standards offered on the market.

Purchase requests from countries not included among those displayed cannot be accepted by the selling company.

All products sold on the Site are covered by the legal guarantee of twenty-four (24) months for lack of conformity, in accordance with the applicable law. The lack of conformity of the product must be communicated to the selling company within two (2) months of its discovery. The lack of conformity can be communicated to the selling company by contacting Customer Service. In the event of a lack of conformity, you have the right to request the repair or replacement of the product. In the event that the aforementioned remedies are not possible or are excessively burdensome, you will be entitled to a reduction in the price paid or the termination of the sales contract, pursuant to art. 130 of the Consumer Code.

Selection of products and order procedure

Sending the order from the Site has the value of a contractual proposal. To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions and procedures contained on the Site. The Customer must add the Product to the "Cart" and, after entering the data necessary for shipping and invoicing, must read the General Conditions and the Privacy Policy and confirm their acceptance. The order request procedure ends with the selection of the desired payment method and the confirmation of order sending through the appropriate button. By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure, made visible on the site with a text box and relative mandatory checkbox. , and to fully accept these transcribed General and payment conditions, in fact expressly accepted by ticking the relevant checkbox (i.e. by placing a check mark in the box containing these general conditions, without which the sale procedure will not continue). He also declares to consent to the processing of his personal data in the manner indicated in the Privacy Policy, also made visible through the text field with the same mandatory checkbox. The contract stipulated between Cosmogel srl and the Customer must be considered concluded and perfected with the acceptance of the order by Cosmogel srl. This acceptance is communicated to the Customer through an e-mail confirming the order itself, the order number, the shipping and billing data, the list of Products ordered, the total price, including delivery costs and the amount of the value added tax (VAT). The Customer will check the confirmation e-mail and if he identifies errors in the order, he will have 12 hours from receiving this e-mail to contact Customer Service directly from the Site using the appropriate contact form. After this deadline, the order will be processed for shipment and changes will no longer be accepted, without prejudice to the Customer's rights as per article 7 below. Upon receipt of the order, Cosmogel srl will check the availability of the items in stock for the fulfillment of the order itself. In the event that one or more Products are not available, Cosmogel srl Customer Service will promptly send an e-mail to the Customer who, within the following 12 hours, will have the right to reply to confirm the shipment of any additional Products available or cancel it. In case of no response within this period, the order will be considered confirmed and the available Products will be shipped. If only a few Products are not in stock, Cosmogel srl will process the order with the Products available. In both cases, the amount relating to the missing Products will be reversed immediately depending on the payment method chosen.

Prices and shipping

The prices of the Products are understood to be inclusive of all taxes and duties. All prices are expressed in Euros. All products are packaged with the necessary precautions to receive maximum protection against shocks and temperature changes.

Product prices may be subject to updates. It is advisable to check the final sale price before submitting the related order proposal.

In the event that the selling company should find a recognizable error in the indication of the price of a Product or in the calculation of the amount requested in payment, it will not accept the order proposal and will contact the user in order to offer the opportunity to transmit the purchase order proposal for the product/s at the correct price.

Terms of payment

The Customer can pay the price of the Products and the related delivery costs by credit card, Paypal and bank transfer.

  • Credit card: payment will be made only after obtaining authorization from the issuer of the credit card for the amount equal to the price of the product ordered. The payment order will be transmitted - via a secure connection - directly to the portal of the bank or financial company expressly indicated by the Customer.
  • PayPal: once the order is confirmed, the Customer will be redirected to the PayPal site where he can make the payment with his account or by using a card, even prepaid, or in any case according to the methods accepted by Paypal and in compliance with the relevant conditions. The costs of Paypal commissions are obviously borne by the customer.

Transport and delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate "addresses" section. All purchases will be delivered by SDA express courier (Monday to Friday, excluding holidays and national holidays). Cosmogel srl is not responsible for unforeseeable delays or those not attributable to it. Once the Products have been shipped, the Customer will receive a confirmation e-mail which will include a link, if available, to refer to for tracking the shipment. In any case, except in cases of force majeure or unforeseeable circumstances, the Products ordered will be delivered within an indicative period of at least 7 (seven) maximum 30 (thirty) working days starting from the day following that in which Cosmogel srl confirmed the order to the Customer by means of a specific order confirmation e-mail. The service includes 1 delivery attempt at the address indicated at the time of the order. A notice will be left after the switch. If the recipient is not traceable or is absent, exceeding the storage period allowed by the carrier, the goods will return to the warehouse. The seller is not responsible in case of failure to collect the parcel in storage, which cannot be a reason for complaint and/or refund.

Right of withdrawal – Complaints

The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except in the cases of exclusion provided for in the following points. To exercise this right, the Customer must send Cosmogel srl a communication no later than 14 days from the date of receipt of the products, and then return them in the ways described below. In the event that the person making purchases on the Site requests an invoice and/or is not a "consumer or user" as defined in art. 3, paragraph 1, lett. a), of the Consumer Code, the withdrawal regulations will not apply, nor, more generally, the provisions that, pursuant to the same Consumer Code, apply only to "consumers". This communication must be sent by registered letter with return receipt, addressed to: info@cosmogel.it. Cosmogel srl Customer Service, once the communication has been received, will open a file for the management of the return and will communicate to the Customer the instructions on how to return the Products, which will take place by courier indicated by Cosmogel srl itself.

In case of exercise of the right of withdrawal, Cosmogel srl will refund the customer the full amount of the returned goods, excluding return costs, within the terms referred to below, always without prejudice to Cosmogel srl's right to suspend the payment of the refund until the actual receipt. of the assets and after checking their integrity (see below). The refund will be made using the same payment method used by the Customer, unless the latter has expressly requested a different method. In case of bank transfer the Customer will be responsible for providing the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN).

The Customer Service of Cosmogel srl will, upon receipt of the notice of withdrawal, open a file for the management of the return and communicate to the Customer the instructions on how to return the Products which must arrive at the seller's warehouses within 14 days from authorization. The refund will be made within 14 days following the return of the purchased goods, with the following clarifications:

  • The shipping costs for the return of the goods are charged to the customer;
  • The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
  • Cosmogel srl is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments; therefore no refund will be made if the returned goods do not return to the seller's warehouses;
  • In case of damage to the goods during transport, Cosmogel srl will notify the customer of the incident (within 5 working days from receipt of the goods in their warehouses), to allow him to file a complaint against the courier he has chosen and obtain a refund of the value of the asset (if insured). In this case, the product will be made available to the customer for its return at the same time as canceling the request for withdrawal.

The right of withdrawal is totally lost, for lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Cosmogel srl ascertains:

  • The lack of the external packaging and / or wrapping containing the purchased product;
  • Damage to the product for reasons other than its transport.

In case of forfeiture of the right of withdrawal, Cosmogel srl will return the purchased good to the sender, charging the shipping costs to the sender.

If the customer wishes to exercise the right of withdrawal for goods not yet received due to delivery delays depending on the carrier, the refund will be made within 14 days from the moment the carrier is ready to return the delivery to the sender. In case of loss of the package, the 14-day deadline for refunding will run from the 30th day following the departure of the purchased goods.

In addition to the cases mentioned above (non-consumer customer and / or who requests an invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:

  • order of products made to measure or clearly personalized;
  • order of Products that are likely to deteriorate or expire rapidly;
  • order of sealed Products that cannot be returned for hygienic reasons or related to health protection and/or that have been opened after delivery.

With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that the Products that "risk deteriorating or expire rapidly" include all food products (including wines, spirits and beverages), as the characteristics and qualities of these types of Products are subject to alteration also as a result of inappropriate storage. Therefore, for reasons of hygiene and customer protection, the right of withdrawal is applicable only for Products purchased on the Site that can be returned to Cosmogel srl and put back on the market without endangering the health of consumers (such as books, gadgets, kitchen utensils, etc.). If the customer also intends to return goods subject to exclusion from the right of withdrawal (pursuant to Article 59 letter b) of Legislative Decree 21/2014), Cosmogel srl will refuse the package and/or will return the Products to the Customer, charging him, in this case, the new shipping costs.
